These terms are an agreement between you and ReadTrack (“ReadTrack”, “we”, “us”) covering your use of readtrack.nz. By creating an account you accept them.
ReadTrack is for teachers and schools. You must be 18 or over and be authorised by your school to assess the students you record. Children do not have accounts.
You confirm, when you create an account, that your school authorises you to record students and that the consent your school requires for this is in place. You are responsible for that being true. We rely on it, and we have no way to verify it.
Record only students you are responsible for assessing, and only for the purpose of assessing their reading.
Student information belongs to you and your school, not to us. We store and process it on your behalf. We do not sell it, do not use it for advertising, and do not use it to train machine learning models. You can ask for it back or ask us to delete it at any time.
ReadTrack itself — the software, the design and the analysis it produces — remains ours. You may use the reports it generates freely in your teaching, including sharing them with colleagues, families and your school.
Prices are in New Zealand dollars. ReadTrack is not currently registered for GST, so no GST is charged and none is shown on your receipt. If that changes we will tell you before it affects what you pay.
Payments are handled by Stripe. Subscriptions renew automatically until cancelled. We may change prices, but not part-way through a period you have already paid for, and we will give existing subscribers at least 31 days' notice by email.
You can cancel at any time. Your access continues until the end of the period you have already paid for, and is not renewed after that. We do not give partial refunds for time remaining, except where required by New Zealand consumer law.
If a payment fails we will try again and let you know. If it stays unpaid, the account reverts to the Free plan. Your existing records are not deleted — you keep access to them, though the Free plan's limits apply to new ones.

ReadTrack is an assistive tool. Transcription and scoring are automated and will sometimes be wrong — particularly with background noise, strong accents or a poor microphone. Its results are a starting point for a teacher's judgement, not a replacement for it, and should not be the sole basis for a decision about a child's education or support.
We work to keep ReadTrack running but do not promise uninterrupted service. It may be unavailable for maintenance, or because of failures beyond our control. We recommend keeping your own copies of anything you rely on.
Nothing in these terms limits rights you have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 that cannot lawfully be excluded. Where you use ReadTrack for business purposes, those Acts do not apply.
Otherwise, and to the extent the law allows, our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim arose. We are not liable for indirect or consequential loss.
You can close your account at any time by contacting us. We will delete your students, their recordings and their results as described in our Privacy Policy.
We may suspend or close an account that breaches these terms. Except in serious cases, we will warn you first and give you a chance to put it right, and a reasonable opportunity to export your data.
We may update these terms. If a change materially affects you we will email account holders at least 31 days before it takes effect. Continuing to use ReadTrack after that means you accept the change.
These terms are governed by New Zealand law, and the New Zealand courts have non-exclusive jurisdiction over any dispute. If something goes wrong, please contact us first — most things are sorted out with an email.
